Terms of sale

1. Purpose

These terms govern the sale of the works offered on totemsauvage.com by Camille Marchand. Each work is an original painting made by hand: the totems in acrylic with a painting knife on a cut-out hardboard (Isorel) panel, the portraits of the Les Gentlemen collection hand painted on an oval panel. Each piece is unique (1/1) and is never reissued.

2. Prices

Prices are shown in euros, all taxes included. For catalogue works, delivery in mainland France costs 12 € per order and is free on any order of 300 € or more (displayed prices, VAT included). Each online order covers a single work. For bespoke commissions and any other destination, delivery is quoted and agreed before payment. The price shown is the one in force at the time of the order.

3. Order, deposit and reservation

Orders are placed from the artwork page. For pieces priced at 150 euros or more, the buyer may choose between paying a 30% deposit (reservation) and paying in full. For pieces priced under 150 euros, payment in full is required at the time of the order: no deposit and no reservation is offered. Payment is processed by Stripe.

A reservation by deposit, available only for pieces priced at 150 euros or more, holds the piece, which is removed from sale, for a period of three (3) months from the date the deposit is received. The balance must be paid before shipping, within this three-month period.

After this three-month period without payment of the balance, the reservation expires automatically and the work is put back on sale. The 30% deposit is then retained by Camille Marchand as compensation for holding the piece during the reservation period.

4. Payment

Payment is made online by card through Stripe, a secure payment provider. No card data is stored by Totem Sauvage.

5. Delivery

Works are shipped after payment in full, in protective packaging suited to the transport of an artwork. The delivery fee, when due, is paid online with the first payment: with the full payment, or with the deposit in the case of a reservation. It never forms part of the 30% deposit, which is calculated on the price of the pieces only, and the balance remains the price of the piece minus the deposit. Times are communicated before shipping. A relief work is never rolled.

6. Certificate of authenticity

Each work is delivered with a certificate of authenticity signed by the artist, stating the title, dimensions and technique.

7. Right of withdrawal

For a catalogue work paid in full at a distance, the consumer buyer has fourteen (14) days from receipt to withdraw, under the conditions provided by law. The work must be returned intact, in its original packaging; return shipping costs are borne by the buyer. This right does not apply to bespoke commissions, which are governed by article 13.

9. Legal guarantees

The buyer benefits from the legal guarantee of conformity under articles L217-3 and following of the French Consumer Code, and from the guarantee against hidden defects under articles 1641 and following of the French Civil Code. These guarantees apply independently of the right of withdrawal and at no cost to the buyer.

A hand-painted work is a unique piece: variations in texture, relief and shade inherent to knife work are part of the nature of the work and do not constitute a defect of conformity.

10. Consumer mediation

Under articles L612-1 and following of the French Consumer Code, a consumer buyer may refer the matter free of charge to a consumer mediator with a view to an amicable settlement, after sending a written complaint to the studio and failing a satisfactory reply within two months.

The details of the competent mediator are provided on request at camille@totemsauvage.com. Buyers residing in another European Union country may also contact the European Consumer Centre of their country of residence.

11. Governing law and disputes

These terms are governed by French law. In the event of a dispute, the parties will seek an amicable solution before any legal action. Failing agreement, French courts have jurisdiction, and a consumer buyer retains the right to bring proceedings before the court of their place of residence.

12. Personal data

Data provided when placing an order is processed in accordance with the privacy policy and the General Data Protection Regulation. It is never sold or transferred.

13. Bespoke commissions

A bespoke commission is a work painted according to the instructions and photographs provided by the buyer, at the prices and formats shown on the Commissions page. The order is formed on payment. Payment in full is required at the time of the order: the deposit and reservation of article 3 do not apply. Delivery costs, which depend on the destination, are stated before any payment.

The lead time of four to six weeks is indicative. It runs from the buyer’s approval of the intention, and Camille Marchand communicates the planned shipping date in writing at that approval.

First step: before starting the work, Camille Marchand sends her intention in writing (format, palette, posture). Until the buyer has approved it in writing, no painting is begun and the buyer may withdraw from the order: all sums paid, delivery included, are then refunded within seven (7) days. After written approval, the order can no longer be cancelled.

Second step: before shipping, Camille Marchand sends the buyer a photograph of the finished work. The buyer may request one retouch, included in the price, once, within five (5) days, limited to the animal’s recognisable features (eyes, coat, markings). The work is a palette-knife portrait: it does not seek photographic likeness, and the retouch cannot aim at it. The work is shipped after the buyer’s agreement or, failing a reply within this five-day period, when it expires.

In accordance with article L221-28, 3° of the French Consumer Code, the buyer does not have the right of withdrawal provided for in article 7 for a bespoke commission, the work being made to the buyer’s specifications. The buyer declares having been informed of this before placing the order.

The steps described above are part of the service and do not constitute a commercial guarantee. They do not limit the legal guarantees of article 9, which remain applicable, in particular where the work does not conform to the approved intention or is damaged in transport.
